Doodle 4 Google - “I love football” Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. CONTEST IS OPEN TO RESIDENTS OF Australia, Czech Republic, France, Germany, Ghana, Hong Kong, Israel, Italy, Japan, Kenya, South Korea, Netherlands, New Zealand, South Africa, Spain, Taiwan, United Arab Emirates, and the United Kingdom (”CONTEST COUNTRIES” OR INDIVIDUALLY, “CONTEST COUNTRY”).

ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

The Doodle 4 Google - “I love football” contest (the “Contest”) is a skill contest where entrants will be asked to create their own interpretation of the Google logo following the theme, “I love football” (“Doodle”). The Doodles will be evaluated in accordance with these Official Rules. The prizes will be awarded to entrants whose Doodles are evaluated as having the highest scores in the judging criteria. See below for the complete details.

  1. BINDING AGREEMENT: In order to enter the Contest, you must agree to these Official Rules (“Rules”). Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. If you are not above the age of majority in the country, state, province or jurisdiction of residence (or at least twenty years old in Taiwan) at the time of entry, you must have the written consent of a parent or legal guardian in order to participate. These Rules form a binding legal agreement between you (and your child, if your child is a minor), and Google with respect to the Contest.
  2. ELIGIBILITY: This Contest is only open to entrants who meet the following the criteria: 1) entrant is between the ages of 4 and 17 at the time of entry; 2) entrant (and if entrant is a minor, participant’s parent or legal guardian) is/are permanent resident(s) of the Contest Countries; (3) neither entrant (or entrant’s parent or legal guardian, if entrant is a minor) is under U.S. export controls or sanctions; and (4) participant has access to the Internet as of 12 April 2010. Contest is void in any country except the Contest Countries, and where prohibited by law. Employees, interns, contractors, and official office-holders of Google or any other entities professionally connected with the Contest or supplying prizes for the Contest and their parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, advertising and promotion agencies, representatives, and agents (“Contest Entities”), and members of the Contest Entities’ and their immediate families (parents, siblings, children, spouses, and life partners of each, regardless of where they live) and members of the households (whether related or not) of such employees, officers and directors are ineligible to participate in this Contest. Winners from past Doodle 4 Google contests are eligible to enter, but are ineligible to win any prizes. Sponsor reserves the right to verify eligibility and to adjudicate on any dispute at any time.
  3. SPONSOR: The Contest is sponsored by Google UK Ltd. (“Google” or “Sponsor”), a United Kingdom corporation with principal place of business at Belgrave House, 76 Buckingham Palace Road, London SW1W 9TQ, UNITED KINGDOM.
  4. CONTEST PERIOD: The Contest begins at 12:00:00 A.M. Greenwich Mean Time (GMT) Zone on 12 April 2010 and ends at 11:59:59 P.M. PT on 11 July 2010 (“Contest Period”). ENTRANTS ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN THEIR RESPECTIVE JURISDICTIONS.
  5. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. To enter the Contest, visit the Contest website located at [Each country’s CMM to INSERT DIRECT URL] (“Contest Site”) during the Contest Period and follow the instructions for on how to participate in the Contest, create doodles, and submit entries (“Doodle”). The Doodle must meet the “Doodle Requirements,” described below.

    LIMIT ONE (1) ENTRY PER ENTRANT. Subsequent entries will be disqualified. Except for the United Kingdom, all entries must be received complete (as determined by Google) by 11:59 p.m. (GMT) on 3 May 2010 to the physical address specified on the Contest Site. For the United Kingdom, all entries must be received complete (as determined by Google) by 11:59 p.m. (GMT) on 10 May 2010 to the physical address specified on the Contest Site. Entries are void if they are in whole or part illegible, incomplete, damaged, altered, counterfeit, obtained through fraud, or late, or if they are received by any means other than delivery to the specified physical address. DO NOT SEND ANY ENTRIES ELECTRONICALLY TO GOOGLE.

  6. DOODLE REQUIREMENTS. The Doodle must meet the following criteria:
    • (a) It must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is in appropriate, indecent, sexual, profane, indecent, tortuous, slanderous, discriminatory in any way, or that promotes hatred or harm against any group or person, or otherwise does not comply with the theme and spirit of the Contest.
    • (b) It must not contain content, material or any element that is unlawful, or otherwise in violation of or contrary to all applicable federal, state, provincial or local laws and regulations the laws or regulations in any jurisdiction where the Doodle is created.
    • (c) It must not contain any content, material or element that displays any third party advertising, slogan, logo, trademark or otherwise indicates a sponsorship or endorsement by a third party, commercial entity or that is not within the spirit of the Contest, as determined by Sponsor, in its sole discretion.
    • (d) It must be an original, unpublished work that does not contain, incorporate or otherwise use any content, material or element that is owned by a third party or entity. This includes, but is not limited to, any copyrighted artwork, representation, logo, or symbol of a specific country, team, sporting event, or sports authority.
    • (e) It cannot contain any content, element, or material that violates a third party’s publicity, privacy or intellectual property rights.
    During the Contest Period, the Sponsor, its agents and/or the Judges (defined below) will be evaluating each Doodle to ensure that it meets the Doodle Requirements. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant who submits an Doodle that does not meet the Doodle Requirements.
  7. JUDGING: Each Doodle will be evaluated and scored based on the following criteria: (1) artistic merit – drawing skills and use of colour; (2) creativity – based on the representation of the “I love football” theme and use of the Google logo; (3) "I love football" theme communication – how well the artist’s concept of the theme is expressed; (4) supporting title and statement – how well the artist explains his/her love of football in 30 words or less; and (5) adherence to the Doodle Requirements and these Contest Rules. Each doodle will then be given a total score made up of scores based upon the above-listed criteria. The Contest will be divided into a National Round and an International Round.
    • National Round (except Ghana, Kenya, and the United Kingdom): In the National Round for all Contest Countries except Ghana, Kenya, and the United Kingdom, the Doodles will be judged separately in each Contest Country sometime between 3 May 2010 and 25 May 2010. The Doodles will be judged first by a panel of experts who are employees of Sponsor (“Google Judges”). The Doodles with the ten highest overall scores from this judging in each Contest Country will then be posted on the Contest Site for the relevant Contest Country for judging by public vote in that Contest Country (“National Voting”). National Voting will be open from 12:00:00 A.M. Greenwich Mean Time (GMT) 1 June 2010 to 11:59:59 P.M. Greenwich Mean Time (GMT) on 7 June 2010. The National Finalist Doodle in each Contest Country with the highest National Voting score will be selected as the National Winner of that Contest Country. In the Czech Republic, Hong Kong, Israel, South Korea, and Taiwan, the Doodle with the second highest National Voting score in that Contest Country will be selected as the National Runner-up of that Contest Country. There will be no National Runner-ups in the other Contest Countries.
    • National Round for Ghana and Kenya: In the National Round for Ghana and Kenya, the Doodles will be judged separately in each Contest Country sometime between 3 May 2010 and 25 May 2010 by Google Judges”). The Doodle with the highest overall score from this judging will be named the National Winner of that Contest Country and the Doodle with the second highest overall score from this judging will be named the National Runner-up of that Contest Country.
    • National Round for the United Kingdom: In the National Round for the United Kingdom, submissions will be divided into four age groups (age 4-7, age 8-11, age 12-14, and age 14 to 17), and into 12 regions (Eastern England, North West, North East, East Midlands, West Midlands, Greater London, South West, South East, Scotland, Wales, Northern Ireland, Yorkshire & Humberside). The Doodles will be judged first by Google Judges between 24 May 2010 and 30 May 2010. The Doodles with the top scores in each age group in each region will be named “Regional Finalists” and the Doodles with the top ten scores in each age group (regardless of region) will be named Age Group Finalists on 7 June 2010. The Doodles of the Age Group Finalists will be posted on the Contest Site for the United Kingdom for National Voting in the United Kingdom. National Voting will be open from 12:00:00 A.M. Greenwich Mean Time (GMT) 7 June 2010 to 11:59:59 P.M. Greenwich Mean Time (GMT) on 11 June 2010. The Doodle with the highest National Voting score in each age group will named the Age Group Finalists and the Doodle with the highest National Voting score across all age groups will be named the National Winner.
    • International Round (all Contest Countries): The Doodles of all the National Winners will then be posted for judging by international public vote on 21 June 2010 (“International Voting”). International Voting will be open from 12:00:00 A.M. Greenwich Mean Time (GMT) 21 June 2010 to 11:59:59 P.M. Greenwich Mean Time (GMT) on 28 June 2010. The Doodle with the highest International Voting score will be selected as the International Winner. The Doodle with the second highest International Voting score will be selected as the International Runner-Up.
    • Tie-breakers: In the event of a tie in the National Voting, the Doodle that received the higher total score from the earlier National Google Judges judging will receive the relevant prize. In the event of a tie in the International Voting, the tied Doodles will be scored by a select panel of International Google Judges and the Doodle with the highest score will receive the relevant prize. In the event of a tie in any Google Judges (National or International) judging, the tied Doodles will be put up for a re-vote amongst the Google Judges until the tie is broken.
    • Selection and Notification of Winners: If no Doodles are received, no prize will be awarded. If a potential winner is disqualified for any reason, the Doodle that received the next highest total score will be chosen as the potential winner. The potential winner(s) will be selected and notified by telephone and/or email, at Sponsor’s discretion, after the end of the Google Judges judging period and before the start date for National Voting. If a potential winner does not respond to the notification attempt within two days from the first notification attempt, then such potential winner will be disqualified and an alternate potential winner will be selected from among all eligible entries received based on the judging criteria described herein. With respect to notification by telephone, such notification will be deemed given when the potential winner engages in a live conversation with Sponsor or when a message is left on the potential winner’s voicemail service or answering machine by the Sponsor, whichever occurs first. Except where prohibited by law, each potential winner may be required to sign and return a Declaration of Eligibility and Liability and Publicity Release and provide any additional information that may be required by Sponsor. If required, potential winners must return all such required documents within seven days following attempted notification or such potential winner will be deemed to have forfeited the prize and another potential winner will be selected based on the judging criteria described herein. In the event the potential winner is a minor, his or her parent or legal guardian must sign the documents and return them as described herein. All notification requirements, as well as other requirements within these Rules, will be strictly enforced. Determinations of judges are final and binding.
  8. PRIZES: Winners for the National Round will be awarded prizes as follows:

    National Winners in all Contest Countries will have their Doodle posted for one day on the Google homepage of their Contest Country on the date specified on the Contest Site and will receive a framed copy of their Doodle (approximate retail value 25 GBP).

     

    In the addition, in the following Contest Countries, the following prizes will be awarded:

    • Czech Republic, Hong Kong and Taiwan: National Winner will also receive Nexus One or Android phone (approximate retail value 400 GBP). National Runner-up will receive digital art supplies (approximate retail value 50 GBP).
    • France: National Winner will also receive a Nexus One phone (approximate retail value 400 GBP).
    • Germany: The National Winner will receive 1 Macbook computer (approximate retail value 530 GBP) and Google will donate 5 Macbook computers (approximate retail value 2650 GBP) to the school of the National Winner’s choice.
    • Israel: National winner will also receive a laptop (approximate retail value 870 GBP). National Runner-up will receive a PSP gaming device (approximate retail value 330 GBP).
    • South Africa, Netherlands and Spain: National Winner will also receive a laptop (approximate retail value 470 GBP).
    • South Korea: National Winner will also receive a netbook computer (approximate retail value 300 GBP) and Google will make a donation of digital equipment (approximate retail value 3320 GBP) to the school of the National Winner’s choice.
    • UAE: National Winner will also receive a laptop with digital art supplies (approximate retail value 670 GBP).
    • Ghana and Kenya: National Winner will also receive a laptop and dongle (approximate retail value 470 GBP). National Runner-up will receive digital art supplies (approximate retail value 50 GBP).
    • United Kingdom: The 48 Regional Finalists will receive a certificate. The 40 Age Group Finalists will receive a framed copy of their Doodle and a goody bag (approximate retail value 10 GBP). The 4 Age Group Winners will receive, in addition to the Age Group Finalists prizes, a laptop (total approximate retail value 600 GBP]

    Winners for the International Round will be awarded prizes as follows:

    • The International Runner-Up will receive a trip to the United Kingdom and 2 VIP tickets to a Premier League football game of Google’s choice (approximate retail value 3700 GPB). The trip portion of the International Runner-Up prize will consist of economy airfare for two (for the contestant and their one parent or guardian) from a major airport closest to the winner to a major airport of Google’s choice; hotel accommodations for two for two nights in a city of Google’s choice; and domestic transport to and from the airport, hotel, and the game for the duration of the two-night stay.
    • The International Winner will have their Doodle posted for one day on the Google.com homepage on 11 July 2010 and will receive a trip to South Africa, consisting of economy airfare for four (one of whom must be the contestant and another of whom must be their parent or guardian) from a major airport closest to the major airport of Google’s choice; nine nights accommodations of Google’s choice; a guide; activities of Google’s choice; and domestic transport to and from the airport, accommodations and activities for the duration of the nine-night stay (approximate retail value 5300 GPB).

    For travel prizes, airfare, accommodations, and transport will be arranged at Google's discretion. Winners are responsible for transport from their home to and from their airport and any other incidentals or expenses such as cost to obtain a passport or visa, vaccinations / medical authorizations, and any other incidental travel cost not expressly stated above. There is no cash alternative and the prizes must be taken as offered. The ARV may be adjusted depending on the state or jurisdiction of residence of the winner.

    Odds of winning any prize depends on the number of eligible entries received during the Contest Period and the skill of the entrants. The prizes will be awarded up to approximately ten weeks of receipt by Sponsor of final prize acceptance documents. No transfer, substitution or cash equivalent for prizes is allowed, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Value is subject to market conditions, which can fluctuate and any difference between actual market value and ARV will not be awarded. The prize(s) may be subject to restrictions and/or licenses and may require additional hardware, software, service, or maintenance to use. The winner shall bear all responsibility for use of the prize(s) in compliance with any conditions imposed by such manufacturer(s), and any additional costs associated with its use, service, or maintenance. Contest Entities have not made and Contest Entities are not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the prize(s), regarding the use, value or enjoyment of the prize(s), including, without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the prize or any components thereto.

     

  9. TAXES: PAYMENTS TO POTENTIAL WINNERS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO GOOGLE ALL DOCUMENTATION REQUESTED BY GOOGLE TO PERMIT IT TO COMPLY WITH ALL APPLICABLE STATE, FEDERAL, LOCAL, PROVINCIAL AND FOREIGN TAX REPORTING AND WITHHOLDING REQUIREMENTS. ALL PRIZES WILL BE NET OF ANY TAXES GOOGLE IS REQUIRED BY LAW TO WITHHOLD. ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. In order to receive a prize, potential winners must submit the tax documentation requested by Google or otherwise required by applicable law, to Google or the relevant tax authority, all as determined by applicable law, including, where relevant, the law of the potential winner’s country of residence. The potential winners and their parents or legal guardians are responsible for ensuring that they comply with all the applicable tax laws and filing requirements. If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and Google may, in its sole discretion, select an alternative potential winner.
  10. GENERAL CONDITIONS: All federal, state, provincial and local laws and regulations apply. Travel companions of the winner(s) must also execute a Declaration of Eligibility and Liability and Publicity Release prior to ticketing and both winner(s) and companions must possess required travel documents (e.g. valid passport and visa if applicable) prior to ticketing. In the event that the travel companion is a minor, his or her parent or legal guardian must execute the required documents. Once the travel schedule has been arranged, it cannot be altered and failure of a winner to follow such schedule shall not obligate Google in any way to provide the winner with alternate arrangements. Google reserves the right to disqualify any entrant from the Contest if, in Google’s sole discretion, it reasonably believes that the entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants, Google, or the Judges.
  11. INTELLECTUAL PROPERTY RIGHTS: As between Google and the entrant, the entrant retains ownership of all intellectual and industrial property rights (including moral rights) in and to the Doodle. As a condition of entry, entrant grants Google and the Contest Entities, including South African Tourism and Sports News Media a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, create a derivative work from, and publicly display the Doodle (1) for the purposes of allowing Google and the Judges to evaluate the Doodle for purposes of the Contest, and (2) in connection with advertising and promotion via communication to the public or other groups, including, but not limited to, the right to make videos, screenshots, animations and Doodle clips available for promotional purposes.
  12. PRIVACY: Entrants agree that personal data entered during the registration, including name, mailing address, phone number, and email address may be processed, stored, shared and otherwise used for the purposes and within the context of the Contest. This data will also be transferred into the United States. By entering, entrants agree to the transmission, processing, sharing and storage of this personal data in the United States.

    Entrants also understand this data may be used by Sponsor in order to verify an entrant’s identity, postal address and telephone number in the event an entry qualifies for a prize. Entrants have the right to access, review, rectify or cancel any personal data held by Google in connection with the Contest by writing to Google at the address listed above. If a participant does not provide the data require at registration, that participant’s entry will be ineligible. Otherwise, all personal information that is collected from the entrant is subject to Google’s Privacy Policy, located at http://www.google.co.uk/intl/en/privacy.html.

    For residents of the EU: pursuant to EU law pertaining to data collection and processing, you are informed that:

    • the data controller is Google and the data recipients are Google, its agents, and affiliated Contest Entities;
    • your data is collected for purposes of administration of the promotion and for marketing purposes;
    • you have a right of access to and withdrawal of your personal data. You also have a right of opposition to the data collection, under certain circumstances. To exercise such right, you may write to Google Inc., 1600 Ampitheatre Parkway, Mountain View, CA 94043.
    • your personal data will be transferred to the U.S.
  13. PUBLICITY. By entering the Contest, entrants agree to participate in any media or promotional activity resulting from the Contest and agree and consent to use of their name and/or likeness by Google and the Contest Entities, including South African Tourism Board and Sports News Media for such media or promotional activity, unless prohibited by law.
  14. WARRANTY AND INDEMNITY: Entrants warrant that their Doodles are their own original work and, as such, they are the sole and exclusive owner and rights holder of the submitted Doodle and that they have the right to submit the Doodle in the Contest and grant all required licenses. Each entrant agrees not to submit any Doodle that (1) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity or confidentiality obligations; or (2) otherwise violates the applicable state, federal, provincial or local law.

    To the maximum extent permitted by law, each entrant indemnifies and agrees to keep indemnified Contest Entities at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each entrant agrees to defend, indemnify and hold harmless the Contest Entities from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from (a) any Doodle or other material uploaded or otherwise provided by the entrant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by the entrant in connection with the Contest; (c) any non-compliance by the entrant with these Rules; (d) claims brought by persons or entities other than the parties to these Rules arising from or related to the entrant’s involvement with the Contest; (e) acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest; (f) any malfunction or other problem with the Contest Site; (g) any error in the collection, processing, or retention of entry information; or (h) any typographical or other error in the printing, offering or announcement of any prize or winners.

  15. ELIMINATION: Any false information provided within the context of the Contest by any entrant concerning identity, mailing address, telephone number, email address, ownership of right or non-compliance with these Rules or the like may result in the immediate elimination of the entrant from the Contest.
  16. INTERNET: Contest Entities are not responsible for any malfunction of the entire Contest Site or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed Doodles due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Contest Site, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an entrant’s ability to participate.
  17. RIGHT TO CANCEL, MODIFY OR DISQUALIFY. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Google reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Google further reserves the right to disqualify any entrant who tampers with the submission process or any other part of the Contest or Contest Site. Any attempt by an entrant to deliberately damage any web site, including the Contest Site, or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Google reserves the right to seek damages from any such entrant to the fullest extent of the applicable law.
  18. NOT AN OFFER OR CONTRACT OF EMPLOYMENT: Under no circumstances shall the submission of a Doodle into the Contest, the awarding of a prize, or anything in these Rules be construed as an offer or contract of employment with either Google, or the Contest Entities. You acknowledge that you have submitted your Doodle voluntarily and not in confidence or in trust. You acknowledge that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between you and Google or the Contest Entities and that no such relationship is established by your submission of a Doodle under these Rules.
  19. FORUM AND RECOURSE TO JUDICIAL PROCEDURES: These Rules shall be governed by, subject to, and construed in accordance with the laws of the United Kingdom, excluding all conflict of law rules. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and all Entrants expressly waive any and all such rights.
  20. ARBITRATION: By entering the Contest, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Contest will be decided by binding arbitration. All disputes between you and Google of whatsoever kind or nature arising out of these Rules, shall be submitted to Judicial Arbitration and Mediation Services, Inc. (“JAMS”) for binding arbitration under its rules then in effect in the London, United Kingdom area, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.
  21. WINNER’S LIST: A list of all winners will be posted on the Contest Site after 11 July 2010 but before 11 January 2011.
  22. LANGUAGE OF RULES: Google may provide you a translation of the English language version of Rules in your local language. Where Google has provided you with such a translation, you agree that the translation is provided for your convenience only and that the English language version of the Official Rules will govern your relationship with Google.
